New Mandatory Data Field - Request for Photo

MLS photography policy calls for a photograph to automatically be taken of regionalized county property that has an address and is NOT marked that a photo will be furnished. Because of this rule, there have been times when the office of these listings did NOT indicate the photo would be furnished and received an automatic charge of $11 on their monthly statement.

In this age of technology, the MLS Committee felt that the policy should be reversed and that photos should be taken ONLY if requested rather than automatically taken if not marked accordingly. Therefore, a request for photo will be added as a new mandatory entry field requiring either a ‘Yes’ or ‘No’ answer for each listing entered. This new field is expected to be added in July.

MLS Director or their designee now authorized to Change Status of Listings found in violation of MLS Policy

Under current policy, REALTORS® can contact MLS regarding the status of property. While MLS can inquire on the status of the property and request it be updated, there is no authority provided for MLS to make the change and staff simply reminds the listing office of the rule or policy. Much of the time, the office makes the needed change.

As a result of several inquiries from REALTORS® pressured to find available properties for their clients, the MLS Committee is currently reviewing this issue and has recommended and CBR leadership has granted authority to the MLS Director or their designee (staff member) to place any listing in contract if it is known to be in violation of the exiting rule or policy.

After the status change is made, MLS then will notify both the listing broker and listing agent of the change via e-mail.

Therefore, please help us maintain data integrity for all REALTORS® by complying with current MLS policy regarding the prompt reporting of in contracts. Your cooperation is appreciated.

           


From the MLS Rules...

SECTION 2.9 REPORTING PENDING SALES (IN CONTRACTS) TO THE SERVICE: Pending sales (in contracts) shall be reported to the Service under the following terms and conditions:
(a) Contingent contracts shall be reported immediately and accurately to the Service by the listing broker within 24 hours after acceptance. The status on the MLS computer will show as contingent contract (AC or AE) indicating the property is in contract but can still be shown but only the AE listings shall remain in the photo section of the current ML publications and be displayed with the AE status visible in print. Further, the terms and conditions of the contingency shall be required and explained briefly in the adjoining space provided and also be visible in print. Both the AC and AE status and the explanation will be displayed until or unless there is a different status change reported and any active status searches will automatically include and identify listings with the AC or AE status.

(b) Pending sales (in contracts) shall be reported immediately and accurately to the Service by the listing broker within 24 hours after the property is no longer available for sale and/or showings. The status on the MLS computer will show as pending (in contract ... UND) and the listing shall be removed from the photo section of the ML publications and maintained in the in contract index for up to one year before being purged from the system or until or unless there is a different status change reported.
