Expired listing information now maintained for two years
Last month, the MLS Committee changed the length of time CBR will maintain expired listing data from one year to two years. This was effective immediately. However, data purged prior to this decision cannot be restored.
CBR Tempo® Photo Purge
After notifying MLS users one month in advance, photos were scheduled to be purged from the CBR Tempo® MLS on April 8, 2004. This purge will then become a weekly event. The purpose of this purge is to conserve disk space and improve system performance.
The purge will only affect photos on Expired, Withdrawn or Sold listings. The exception to this will be active MLS listings that, due to a previous system problem, have more than 10 photos on them. In these instances all photos in excess of 10 will be removed. The Primary photo on a listing will never be removed.
If there are photos on listings that you would like to save please do so before 04/08/04. If you need instruction on how to save these photos please contact Technical Support.
The ongoing schedule for purges will be as follows:
- One-year anniversary of Status Change: Purge of photos 6 - 10
- Two-year anniversary of Status Change: Purge of photos 2 - 5
Please Check Your Agent/Office Roster Information in CBR Tempo®
In March, we began synchronizing the data between CBR’s membership database and the MLS database. Not surprisingly, we’re discovering discrepancies. To check your roster information in CBR Tempo®, go to Member Info on the Tempo® toolbar, select Roster and run a search on yourself. If you discover incorrect or outdated information please let us know so that we can update your record.
No names on photos - 2nd Notice
In February, the Board of Directors, upon recommendation of the MLS Committee, approved that no name text appear on photos regarding copyright except those taken by MLS.
According to CBR attorney Jack Burtch of Baker and Hostettler, the rights of the agent photographer are protected as photos submitted to MLS automatically have implied copyright held by the person taking the photo.
All photos appearing within the Tempo system are assumed to be copyrighted by the listing agent/brokerage or professional photographer unless the MLS copyright logo appears on the photos. No further pictures with names will be accepted into the MLS system. Members may reuse only those photos that have the CBR-MLS logo on them.
Copyright/Disclaimer language will appear on each page of the MLS books as well as on CBR MLS printouts.
Condominium Listing Submission Policy- Reminder
Developer’s Statement - For a condominium to be listed for sale in the MLS, the property must have a Developer’s Statement as required by Ohio Revised Code Sections 5311.25 and 5311.26. No more than 5 percent or a maximum of 5 units per subdivision can be shown as active per broker in the MLS, provided a Developers’ Statement exists. If there is no Developer’s Statement, then property cannot be listed. If a question arises that no document exists, the MLS Director shall request from the listing broker a copy of the Developer’s Statement for the project and address in question. The listing broker shall provide, within seven (7) days, the specific Developer’s Statement. If none is provided in the prescribed time frame, then the MLS Director or their designee shall immediately remove said listings in questions from the MLS system. Once the document is provided, then the maximum of 5 units can be listed.
Declaration of Condominium Property - For a broker to list more than 5 units for sale in a condominium project, then a recorded Declaration of Condominium Property must exist. It must meet the requirements of Ohio Revised Code Sections 5311.06 and 5311.07. If the condominium documents are recorded then there shall be no limit on the number of units listed for sale in the MLS, provided there are Declaration of Condominium Property documents for the specific unit address. If a question arises that no document exists, the MLS Director shall request from the listing broker a copy of the Declaration of Condominium Property document for the project and address in question. The listing broker shall provide, within seven (7) days, the specific Declaration of Condominium Property document. If none is provided in the prescribed timeframe, then the MLS Director or their designee shall immediately remove all but 5 of the listings in question from the MLS system.
